Terms of Service

These Terms govern your use of mynycwebsite.com (the Site) and any order you place on it. They sit alongside our Privacy Policy, Shipping Policy and Refund and Returns Policy, which form part of the same agreement. By browsing the Site or completing an order you accept them. If you do not accept them, please do not use the Site.

1. Who you are dealing with

Mynycwebsite is the trading name of BROOKTABLE LLC, based in FREMONT, OH. We sell Small-Space Living products online only; there is no retail counter.

2. Eligibility

You must be at least 18 years old to order, or have the permission of a parent or legal guardian who accepts these Terms on your behalf. You agree that the details you give us, including name, delivery address, billing address, email and phone number, are accurate and current, and that you will correct them if they change while an order is open. Orders whose details we cannot verify may be held or cancelled.

3. Accounts

An account is not required in order to buy, but if you open one the login details are yours to protect. Anything done through your account is treated as done by you. Tell us at support@mynycwebsite.com the moment you suspect someone else has access, and we will help you secure it.

4. Products and availability

Product pages describe each item as accurately as we can, using the measurements, materials and contents supplied to us. Photographs are illustrative: colours vary between screens, and hand-measured dimensions can differ slightly from the printed figure. Stock, specifications and the catalogue itself may change without notice, and we may withdraw or alter a listing at any time.

5. Prices, taxes and errors

Prices are shown in US Dollars (USD) and do not include sales tax unless a page says otherwise. Tax, where it applies, is calculated and displayed at checkout, and the total you approve there is the total you pay. We may change prices at any time, though a change never applies to an order already confirmed. Where an obvious pricing or description error appears, we may cancel the affected order and refund it in full rather than fulfil it at the wrong figure, and we will tell you before doing so.

6. Orders and acceptance

Submitting an order is an offer to buy. The confirmation email acknowledges that we received it, not that we accepted it; the contract is formed when we dispatch the goods. We may decline or cancel an order, for example where stock has run out, where an address cannot be delivered to, or where a payment or fraud check fails, and we refund in full when we do. If you need to cancel, write to support@mynycwebsite.com as soon as possible; once an order has been processed or shipped, cancelling may no longer be possible.

7. Payment

We accept Shop Pay, Shop Pay Installments (orders of $35 or more), Apple Pay, Google Pay, PayPal, Venmo, Visa, Mastercard, American Express, Discover, Diners Club, Elo, JCB, and UnionPay. Payment is taken at checkout through Shopify Payments over an encrypted, PCI-DSS compliant connection, and full card details are never stored by us. Every charge is displayed before you confirm. There are no hidden fees and nothing is added later.

8. Shipping

We ship within the United States only, to all 50 states, and not internationally. There is a single service: free standard shipping, with no minimum order and no expedited option. Processing takes 0-1 business days and delivery a further 2-3 business days, with a tracking number emailed at dispatch. Delivery windows are estimates rather than guarantees and depend on the carrier. Our Shipping Policy carries the full detail.

9. Returns and refunds

Returns are accepted for manufacturing defects, damage in transit and wrong items received, within 30 days of delivery. Change of mind and personal preference are not covered. The Refund and Returns Policy sets out the conditions, the evidence we need and the timings, and it forms part of these Terms.

10. Intellectual property

The text, layout, graphics, photographs, logos and arrangement of the Site are owned by or licensed to Mynycwebsite and are protected by copyright, trademark and other intellectual property laws. You may view and print pages for your own personal use. You may not copy, republish, scrape, resell or adapt any part of the Site for commercial purposes without our prior written permission.

11. Acceptable use

• Do not use the Site for anything unlawful or fraudulent, including orders placed with a payment method that is not yours.
• Do not interfere with the security, availability or operation of the Site.
• Do not scrape, harvest, mirror or bulk-copy content, prices or images.
• Do not upload or transmit malicious code.
• Do not attempt to reach any part of the Site, its servers or another customer's data that is not meant for you.

12. Disclaimer of warranties

The Site and its content are provided on an as-is and as-available basis. We work to keep the information accurate and the service running, but we do not warrant that the Site will be uninterrupted, error-free or free of harmful components, or that every description is complete. Products carry whatever statutory rights apply to them, and nothing here removes a right you hold by law.

13. Limitation of liability

To the fullest extent the law allows, Mynycwebsite and BROOKTABLE LLC are not liable for indirect, incidental, special, consequential or punitive damages arising from your use of the Site or your purchase of a product, including lost data, lost revenue or lost profits. Where liability cannot lawfully be excluded, it is limited to the amount you paid for the order that gave rise to the claim.

14. Indemnity

You agree to indemnify and hold harmless BROOKTABLE LLC, its officers and its employees against any claim, loss, liability or reasonable cost arising from your breach of these Terms, your misuse of the Site, or your infringement of another person's rights.

15. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains what we collect, why we hold it, and who else sees it.

16. Governing law

These Terms, and any dispute arising out of them or out of your use of the Site, are governed by the laws of the State of Ohio and of the United States, without regard to conflict-of-law rules. The courts located in State of Ohio have jurisdiction over any such dispute.

17. Changes and severability

We may revise these Terms. The current version is always the one on this page, carrying its effective date, and continuing to use the Site after a change means you accept the revision. If any provision is held unenforceable, the remainder stays in force.
